Privacy Policy

This Privacy Policy describes how Peach Works, Inc., doing business as Encore ("Encore," "we," "us"), collects, uses, and shares personal information. It applies to: (1) people who see or claim Encore offers inside our partner apps; (2) our business partners’ personnel who use our website and dashboard; and (3) visitors to encorekit.com.
What Encore does
Encore helps apps and games present brand-funded offers — such as a free month, extended trial, or discount on a subscription service — at natural moments in the app experience. Depending on the app, that might be reaching a milestone or streak, completing or declining an in-app purchase, checking an in-app mailbox, or a similar moment the app chooses. Our technology (an SDK or API integrated by the partner app) selects and presents these offers. If you see an Encore offer in an app or game, that app is our partner. Claiming an offer is always optional; if you decline or ignore one, nothing changes in your app experience.
Information we collect
From partner apps
Partner apps decide what information to send us. Depending on the partner, this may include: a pseudonymous identifier (a random ID tied to a device or app installation — not your name); in-app event data (for example, that a milestone was reached, a purchase screen was shown or declined, an offer was shown, or an offer was claimed); demographic or profile attributes the partner chooses to share, such as age or age range, gender, or approximate location (such as your country or region); and, where a partner provides it, contact or account information such as a name or email address. In many cases, we receive only a pseudonymous identifier and event data, and we do not know who you are.
When you claim an offer
If you claim an offer, we collect the information needed to deliver it — for example, an email address to send a redemption code, if the claim flow asks for one. The brand fulfilling your offer (for example, the subscription service providing your free month) will collect information directly from you under its own privacy policy when you redeem.
From business partners
If you use our dashboard or interact with us as a partner or prospective partner, we collect account and contact information (name, work email, company), payment details needed to pay revenue share, and usage information about the dashboard.
Automatically
When you use our website, or when our technology operates inside a partner app, we and our service providers automatically receive technical information such as IP address, device type, operating system, browser type, timestamps, and interaction events. Our website uses cookies and similar technologies; see "Cookies" below.
How we use information
We use the information described above to: operate and improve the Encore platform; select and present offers, including choosing which offers may be relevant; deliver rewards when offers are claimed; measure offer activity and calculate and pay amounts owed to partner apps; detect and prevent fraud and abuse; provide dashboards, support, and communications to business partners; comply with law; and protect our rights and the security of our services.
Your rights and choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain processing. To exercise any of these rights, email support@encorekit.com. Because the data we hold about app users is usually keyed to a pseudonymous identifier rather than a name, we may ask you (or the partner app) for information needed to locate the relevant records — or direct you to the partner app, which controls its own data about you. We will not discriminate against you for exercising your rights, and authorized agents may submit requests on your behalf where the law provides.
You can also simply ignore or decline any Encore offer — participation is always voluntary.
Retention
We keep personal information only as long as needed for the purposes described in this policy — including calculating and paying partner revenue share, meeting legal and audit obligations, and preventing fraud — and then delete or de-identify it. Event data used for reporting is retained in aggregated or de-identified form.
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, appropriate to the nature of the data we hold. No system is perfectly secure; if we learn of a breach affecting your personal information, we will notify affected parties as required by law.
Children
Our services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact support@encorekit.com and we will delete it.
International users
Encore is based in the United States, and the information we collect is processed and stored in the United States, where privacy laws may differ from those in your jurisdiction. Where required by applicable law, we implement appropriate safeguards for personal information received from other jurisdictions.
US state privacy rights
If you are a resident of California or another US state with a comprehensive privacy law, the rights described in "Your rights and choices" above apply to you, including the rights to know, delete, and correct. We do not sell personal information and do not share personal information for cross-context behavioral advertising as those terms are defined under applicable state law; our websites honor the Global Privacy Control signal where required. We collect the categories of personal information described in "Information we collect" for the purposes described in "How we use information," and disclose them as described in "How we share information."
Data Privacy Framework
Peach Works, Inc. (d/b/a Encore) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Peach Works, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. DPF Principles, the UK Extension, and the Swiss-U.S. DPF Principles with regard to the processing of personal data received from the European Union, the United Kingdom (and Gibraltar), and Switzerland in reliance on the applicable DPF. If there is any conflict between the terms in this privacy policy and the DPF Principles, the Principles shall govern. The personal data we receive under the DPF is provided to us by our partner applications and may include pseudonymous identifiers and related in-app event data; demographic and profile attributes a partner chooses to share (such as age or age range, gender, or approximate location); and, where a partner provides it, contact or account information such as a name or email address. We process this data to operate the Encore platform, select and present offers, calculate partner payments, and prevent fraud, as described in this policy. Peach Works, Inc. is responsible for the processing of personal data it receives under the DPF and for onward transfers to third parties acting as agents on its behalf, and remains liable under the Principles if such agents process the data in a manner inconsistent with the Principles, unless we prove we are not responsible for the event giving rise to the damage. Peach Works, Inc. is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.
In compliance with the DPF, Peach Works, Inc. commits to resolve complaints about our collection or use of your personal data. Individuals in the EU, UK, or Switzerland with inquiries or complaints regarding our handling of personal data should first contact us at admin@encorekit.com. We have further committed to refer unresolved DPF complaints to JAMS, an alternative dispute resolution provider based in the United States, at no cost to you. Under certain conditions, you may invoke binding arbitration as described in Annex I of the DPF Principles. You also have the right to access the personal data we hold about you and to limit its use and disclosure; to exercise these rights, contact us at the address above.
Changes to this policy
We may update this policy from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. The current version will always be available on this page.
